Doubt with the Defense

Hello everybody!
I have a question about defense in combat: when I am attacked in melee, I can sacrifice my next action to use defense. Then both contestants make an opposing roll. My question is: if my opponent fails his attack (that is, he does not obtain any success on the roll), is it legal for me to spend my successes obtained on Defense stunts, or if my opponent fails his attack, my roll no longer counts ( although I have spent my action)?
